The Statutory Role of a Notary Public

Understanding the specialized legal professional required to draft and authorize your Antenuptial Contract.

Back to Knowledge Hub

When preparing your matrimonial property regime, precision is everything. In South Africa, certain high-stakes documents require an elevated level of statutory oversight to be legally recognized. The professional granted this authority is known as a Notary Public.

The Sole Authority for Antenuptial Contracts

In South Africa, an antenuptial contract must be executed before a Notary Public admitted to practise as such by the High Court. This is a legal requirement for couples who wish to marry out of community of property.

A Notary Public is a specialist attorney who has completed additional qualifications and has been admitted by the High Court to prepare, execute, and register certain specialised legal documents, including antenuptial contracts.

An online template or privately drafted agreement does not by itself satisfy the legal requirements for a validly executed Antenuptial Contract. For an antenuptial contract to have legal effect, it must be properly executed before a Notary Public and registered in accordance with South African law.

What Does a Notary Public Do?

Preparing an antenuptial contract involves far more than witnessing signatures. A Notary Public guides the process from legal advice through to registration at the Deeds Office.

⚖️ Why It Matters

A Notary Public is more than a witness. They are a specialist legal practitioner authorised to prepare, execute, and register antenuptial contracts, ensuring they comply with South African law.
