The Antenuptial Contract Process

An antenuptial contract must be concluded before marriage in order to regulate the financial consequences of the marriage. The process involves structured legal drafting, formal execution before a Notary Public and registration at the Deeds Office.

Step 1 — Consultation and Information Gathering

The process begins with structured information gathering. Clients provide identity details, the intended date of marriage and clarity regarding their preferred matrimonial property regime.

Where consultation is included, the legal implications of each regime are explained, including asset protection, business risk exposure, estate planning considerations and accrual calculations.

Step 2 — Drafting by a Notary Public

The antenuptial contract is drafted by a Notary Public in accordance with the Deeds Registries Act. The document must accurately reflect the chosen matrimonial property regime, commencement values where the accrual system applies, and any agreed exclusions.

Precision at this stage is essential, as errors or ambiguities may create future disputes or require costly rectification proceedings.

Step 3 — Execution Before the Marriage Ceremony

The antenuptial contract must be executed before the marriage ceremony. Both parties sign the contract before a Notary Public and two witnesses.

Where personal appearance is not possible, a properly drafted Special Power of Attorney may authorise an agent to sign on behalf of a party.

If the contract is not executed before marriage, the default matrimonial property regime becomes marriage in community of property.

Step 4 — Registration at the Deeds Office

After execution, the antenuptial contract must be registered at the Deeds Office. South African law requires registration within three (3) months from the date of execution.

Registration gives the contract full legal enforceability and places it on public record.

Step 5 — Failure to Register in Time

If the contract is not registered within the prescribed period, it cannot operate against third parties.

Late registration requires a High Court application seeking condonation. This involves additional legal costs, delay and judicial discretion.

If condonation is not granted, the marriage remains in community of property.
